1. Acceptance of Terms

By accessing or using ball8n ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to all of these terms, you may not access or use the Service. ball8n is operated by ball8n GbR, a registered German partnership (Gesellschaft bürgerlichen Rechts).

2. Description of Service

ball8n provides an automated price testing platform for Amazon sellers via the Amazon SP-API. The Service enables users to conduct pricing experiments, analyze results, and optimize their product pricing strategies. The Service is currently offered in a free Beta phase as described in our Pricing page.

3. Beta Disclaimer

The Service is provided in a "Beta" phase and is offered "as is" without warranty of any kind, express or implied. During the Beta phase:

• The Service may contain bugs, errors, or limitations.
• Features and functionality may change without notice.
• ball8n GbR reserves the right to modify, suspend, or discontinue the Service at any time.
• Beta users will not be charged and will not be automatically enrolled in any paid plan after the Beta concludes.
• ball8n GbR shall not be liable for any damages arising from the use of the Service during the Beta phase.

4. User Obligations

As a user of the Service, you agree to:

• Comply with all applicable laws and Amazon Acceptable Use Policies.
• Maintain the confidentiality of your account credentials.
• Provide accurate and complete information during registration.
• Not use the Service for any unlawful or unauthorized purpose.
• Not attempt to access, aggregate, or redistribute data belonging to other sellers.
• Not use the Service to calculate insights about Amazon's broader business.

5. Intellectual Property

The Service, including its software, design, text, graphics, and logos, is the intellectual property of ball8n GbR and is protected by German and international copyright laws. You may not reproduce, distribute, modify, or create derivative works of the Service without our express written consent.

6. Limitation of Liability

To the maximum extent permitted by applicable law, ball8n GbR shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, or business opportunities, arising out of or in connection with the use or inability to use the Service. This limitation applies regardless of the legal theory under which damages are sought.

7. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Federal Republic of Germany. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Berlin, Germany.
